Slip and Fall Accident
Accident Scenario
Our team worked closely with our client “GP” to ensure she received maximum compensation for her injuries. GP was a 63-year-old woman from Ottawa. One day she was walking in a parking lot and slipped and twisted her right ankle on a freshly painted line during a rain storm. These types of slip-and-fall accidents are not uncommon. A change in weather can suddenly bring on hazardous situations. Often times when it rains, the ground can become slippery. Freshly painted ground can cause an even bigger hazard.
Injuries Resulting From Accident
Stores, private residences and municipalities have a responsibility to keep their premises safe. This means that they must make their property as reasonably safe as possible to ensure that there are no hazards and that people entering their property are not at risk of serious injury, as the result of a slip and fall or trip and fall accident. Unfortunately in our client’s situation, the freshly painted line did cause a serious hazard when it became wet and consequently, our client suffered very serious personal injuries, including a right ankle fracture.
Compensation for Injury
A slip-and-fall accident can be caused by many different things. Typically, most slip-and-fall accident cases we see involve:
- cracks in pavement or uneven sidewalks
- stairs that are not to code or dangerous
- wet or damp floors
- mats that are not lying flat or not secured properly
- icy or snow on walkways
- item not properly secured and fall off shelves in stores
- property that has not regularly been inspected and repaired
- items that have fallen on the floor in stores (for example: someone who slips on a grape)
- shopping cart accidents
These are just some of the more common slip-and-fall accidents we see. Our client was injured on someone else’s property. Thankfully her injuries healed well after she treated her injury correctly with proper rehabilitation and physiotherapy. We were able to help have her treatments covered and after tough negotiation, we were able to get the insurance company to settle at a private settlement conference. GP received $ 35,000 from the tort action. Thankfully most bone fractures heal well and quickly. Our client was one of the lucky ones whose injuries can heal. Not all slip-and-fall accidents end this way.
If you or a loved one has been injured in a slip and fall accident, it’s important you treat your injury properly to ensure that the healing process is 100% and it’s important you know what compensations you may need and are entitled to.
